What Tennessee Requires for an Uncontested Divorce

To qualify, both spouses must fully agree in writing on every major issue before the court can act. A single unresolved term converts the case to a contested divorce. At least one spouse must also have been a Tennessee resident for a minimum of six months before filing. Note that one attorney can’t represent both spouses. Each party should have independent legal representation.

The required agreements cover:

• Division of marital property and debts captured in a Marital Dissolution Agreement, the primary document the court will review
• Spousal support, including whether alimony will be paid and on what terms, or a mutual waiver of it
• A Permanent Parenting Plan addressing custody, decision-making authority, parenting time, and child support whenever minor children under age 18 are involved
